StubHub Settlement: $10 Million Fine for Hidden Ticket Fees

StubHub to Pay $10 Million for Misleading Ticket Pricing

StubHub Holdings (STUB-N) has agreed to a US$10-million settlement with the U.S. Federal Trade Commission (FTC) following charges that the platform failed to adequately disclose the full cost of event tickets to consumers. This landmark case highlights a growing crackdown on hidden fees within the ticket resale market.

The FTC’s Complaint and the ‘Fees Rule’

According to the FTC’s complaint, filed with the U.S. District Court for the Southern District of New York, StubHub advertised ticket prices on its website without clearly displaying all mandatory fees upfront. This practice meant consumers were often surprised by the final price at checkout. The FTC began enforcing its “Fees Rule” in May of last year, mandating businesses to provide complete price transparency for live event tickets.

The agency had previously issued a warning letter to StubHub after the rule’s implementation, signaling concerns about their pricing practices. StubHub did not immediately respond to requests for comment regarding the settlement.

What Does This Settlement Mean for Consumers?

This settlement will result in monetary relief for eligible consumers who were affected by StubHub’s misleading pricing. More importantly, the order requires StubHub to prominently display the total ticket price – including all fees – on its platform. This change aims to provide consumers with a clear and accurate understanding of the total cost before making a purchase.

Increased Scrutiny of the Ticket Resale Market

The FTC’s increased enforcement efforts are a direct result of a Trump administration executive order issued in March of last year. This order directed the FTC to ensure price transparency throughout the entire ticket-purchase process, including the secondary ticketing market. The order specifically called for “appropriate action” to address hidden fees and deceptive practices.

This case serves as a warning to other ticket resale platforms. The FTC is actively monitoring the industry and will likely pursue further action against companies that fail to comply with the Fees Rule. Consumers are encouraged to report any instances of hidden fees or deceptive pricing practices to the FTC.
