Ontario’s police watchdog, the Special Investigations Unit (SIU), has stated it is not currently investigating allegations of assault against Durham Regional Police officers involving lawyer Sudine Riley at an Oshawa courthouse last week. The SIU was notified of the incident on Tuesday but has not invoked its mandate at this time.

The SIU’s jurisdiction is limited to cases involving serious injury, death, allegations of sexual assault, or the discharge of a firearm by an officer. This narrow scope is currently preventing their involvement, despite the gravity of the claims.

Allegations of Assault

According to a statement released by Sudine Riley’s counsel, Neha Chugh, the defence lawyer sustained injuries after allegedly being physically assaulted by Durham police officers in an interview room last Friday. Ms. Chugh alleges her client was slammed headfirst into a desk, resulting in bleeding and swelling.

The statement further details allegations that officers placed their knees on Ms. Riley’s back and neck, subsequently dragging her from the room in handcuffs and detaining her in the courthouse basement. Disturbingly, Ms. Riley, who is Black, also claims her head scarf was forcibly removed and her skirt raised during the incident.

Police Response and Investigation

Durham Regional Police have acknowledged the allegations, stating they are taking them “extremely seriously.” They have notified the Law Enforcement Complaints Agency and reassigned the officers involved to duties not involving courthouse security. The police emphasize that the officers are entitled to due process during the ongoing investigation.

Police have charged Sudine Riley with trespassing. However, the focus remains on thoroughly investigating the alleged assault.

Calls for Independent Investigation

Legal organizations, including the Criminal Lawyers’ Association, are demanding an independent investigation into the incident. They argue that lawyers must be able to perform their duties safely within Ontario’s courthouses. The Canadian Bar Association has echoed these calls, emphasizing the need for a “thorough, transparent, and independent investigation without delay.”

This case highlights critical concerns about police conduct and the safety of legal professionals. The demand for an independent review underscores the need for accountability and transparency in such sensitive matters.
