BREVARD COUNTY, Fla. – A Brevard County jury has delivered a staggering $14 million+ verdict to a woman, Brandy Buckley, who experienced a horrific ordeal after consuming ice cream contaminated with metal. According to court records obtained by News 6, the incident occurred in 2018 at a Malabar, Florida ice cream franchise. Buckley purchased the contaminated ice cream through the drive-thru window at the location on 329 Malabar Road in Palm Bay.
The Contamination and Initial Injuries
The lawsuit detailed a disturbing discovery: the ice cream contained not one, but two nails, along with several small metal fragments. Upon consuming the product, Buckley immediately sought emergency medical attention. Doctors were able to surgically remove one nail and multiple pieces of metal.
Long-Term Health Complications
Unfortunately, the initial injuries were just the beginning. Buckley subsequently developed serious complications, including portal vein thrombosis and significant internal bleeding. These complications necessitated an ablation procedure, which tragically resulted in permanent infertility, as noted by Alpizar Law.

The jury found the national franchisor liable under an agency theory, extending responsibility beyond the individual franchise location. This decision underscores the importance of maintaining consistent safety standards across all branches of a franchise.
